We succeeded in bringing unlawful practices of the Agency for Payments and Intervention in Agriculture to an end.
Our client was penalised for allegedly failing to cultivate the entire declared area organically, based on remote sensing. However, the certification body she had engaged had verified on site that the entire declared area was organically farmed.
After administrative complaints against the payment decision and irregularity reports were rejected, we applied to the Timiș Tribunal. It ruled in our favour, but its reasoning incorrectly stated that the certification body lacked authority to inspect the declared agricultural areas.
The Timișoara Court of Appeal allowed our client's appeal on points of law, amended the lower court's reasoning as requested and ordered A.P.I.A. to issue a new administrative act and pay all amounts claimed. The authority's own appeal was dismissed as unfounded.
We are pleased to support our clients in difficult administrative and tax disputes and to challenge unlawful conduct by public authorities and institutions.
Representation in the administrative dispute was provided by lawyer Dr Dan-Adrian Cărămidariu.
