We are pleased to have helped, over almost two years, bring a ten-year dispute to an end. Yesterday, the First Civil Division of the High Court of Cassation and Justice allowed our appeal on points of law and definitively held a contractor and project owner jointly and severally liable for damage caused to our clients by defective public utility works in Timișoara.
In 2015, the two claimants' homes were seriously damaged by work on the water supply network. After the first round of proceedings, in March 2022, the Supreme Court remitted the case to the appeal court to establish the culpable acts of the two defendant companies. Our team took over this difficult case in November 2023, during the rehearing of the appeal.
In February 2024, the Timișoara Court of Appeal again allowed the claimants' appeal against the Timiș Tribunal's 2019 judgment, but removed the defendants' joint and several liability. Our appeal based on the incorrect application of Article 1382 of the Civil Code was allowed, enabling the claimants to recover their entire loss from either defendant.
We are proud of our contribution to the final success in this case and that the High Court accepted the soundness of our arguments.
The clients were represented by lawyer Dr Dan-Adrian Cărămidariu.
