We secured an important outcome for a client in a particularly difficult legal position. He was charged with driving under the influence of psychoactive substances while serving a suspended sentence for high-risk drug trafficking. This would normally have led almost inevitably to imprisonment and revocation of the suspension. Following our arguments, however, the court imposed a fine.
Drawing on leading international toxicology studies, we showed that the blood amphetamine level was within the therapeutic range and far below thresholds associated with impaired driving. The court found no relevant impairment of reflexes, coordination or motor function and accepted, consistently with our arguments and specialist literature, that the detected level was not capable of affecting driving ability.
The court also considered the client's improved conduct: on our advice he attended counselling, returned to work, continued his studies, volunteered and adopted an honest, cooperative procedural approach. Taking all circumstances and statutory sentence-reduction mechanisms into account, the court avoided imprisonment and did not revoke the suspension, imposing a financial penalty instead. The judgment became final without appeal.
The result confirms the decisive role of a scientifically grounded defence and a genuine, sustained and documented reintegration process.
